DialAnytime is a service operated by Kingmaker Analytics LLC ("Kingmaker Analytics," "we," "us," or "our"), a limited liability company. References to "DialAnytime" in these Terms refer to the service and brand operated by Kingmaker Analytics LLC.
Please read these Terms of Service ("Terms") carefully before using DialAnytime. By creating an account, accessing, or using our service in any way, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, do not use our service.
1. Eligibility and Age Requirement
You must be at least 18 years of age and a resident of the United States to create an account and use DialAnytime. By registering, you represent and warrant that you are 18 or older, that you reside in the United States, that you have the legal capacity to enter into a binding agreement, and that your use of the service complies with all applicable laws in your jurisdiction.
DialAnytime is not directed to, and is not intended for, individuals under the age of 18. We do not knowingly collect personal information from anyone under 18. If we learn that a user is under 18, we will promptly terminate their account and delete any associated personal data. If you believe a minor has created an account, please notify us immediately through our contact page.
2. Account Registration and Security
To use DialAnytime, you must create an account and provide accurate, complete, and current information, including a valid email address and phone number. You are responsible for keeping your account credentials confidential and for all activity that occurs under your account.
You agree to:
- Provide truthful and accurate information during registration
- Keep your login credentials secure and not share them with anyone
- Notify us immediately if you suspect unauthorized access to your account
- Register only one account per person
We are not responsible for any loss or damage resulting from unauthorized use of your account.
Setting up an account for someone else. If you create an account on behalf of another person (for example, setting up service for a family member), you represent and warrant that: (a) you have their informed consent to create the account and agree to these Terms on their behalf; (b) you have explained to them, or will explain before their first use, that they will be speaking with an AI assistant, not a human; (c) you accept joint responsibility with the account holder for compliance with these Terms and for all charges incurred on the account; and (d) you will ensure the account holder has access to these Terms, our Privacy Policy, and our AI Disclosure. By placing their first call, the account holder confirms their acceptance of these Terms.
3. Service Description
DialAnytime is a subscription-based phone service that connects you to an AI-powered voice assistant. When you call our designated phone number, our system verifies your identity, checks your subscription status and available minutes, and connects you to the AI assistant if authorized.
The AI assistant is designed to answer general everyday questions on a wide range of topics. You receive a monthly allotment of call minutes based on your chosen plan, and your usage is tracked through your online dashboard.
We reserve the right to modify, suspend, or discontinue any aspect of the service at any time. If we permanently discontinue the service, we will provide reasonable advance notice and refund any prepaid, unused subscription fees.
4. Not an Emergency Service
DialAnytime is not an emergency service and must never be used as a substitute for calling 911 or any other emergency number.
If you are experiencing a medical emergency, a threat to your safety, or any situation that requires immediate assistance from police, fire, or medical responders, hang up and call 911 (or your local emergency number) right away.
Our AI assistant cannot dispatch emergency services, contact anyone on your behalf, or assess the severity of an emergency situation. Do not rely on DialAnytime in any urgent or life-threatening circumstance.
5. AI-Generated Content and Accuracy
All responses provided by the DialAnytime voice assistant are generated by artificial intelligence. You should understand the following about AI-generated content:
- Responses may be inaccurate. AI-generated answers may contain errors, be incomplete, be outdated, or present information that is factually incorrect. The AI does not have real-time awareness of current events or access to verified databases of facts.
- Responses are not personalized advice. The AI does not know your personal circumstances, health history, financial situation, or legal standing. Its responses are general in nature and should be treated accordingly.
- Responses do not reflect our views. AI-generated content does not represent the opinions, endorsements, or recommendations of DialAnytime, its owners, employees, or affiliates.
- Responses may vary. Due to the nature of AI, different users asking similar questions may receive different answers. The same question asked at different times may produce different responses.
- You are responsible for how you use AI responses. You must evaluate any response for accuracy and appropriateness before relying on it or acting on it. We strongly encourage you to verify important information with independent, authoritative sources.
You agree that you will not rely on any AI-generated response as a sole source of truth, as the basis for any important decision, or as a substitute for professional judgment in any field.
6. No Professional Advice
DialAnytime does not provide professional advice of any kind. The AI assistant is a general-purpose conversational tool. It is not a licensed professional and cannot replace one.
Specifically, DialAnytime responses do not constitute and must not be relied upon as:
- Medical or health advice. Do not use DialAnytime to diagnose symptoms, choose treatments, adjust medications, or make any health-related decisions. Always consult a licensed physician, nurse, pharmacist, or other qualified healthcare provider for medical questions.
- Legal advice. Do not use DialAnytime for legal guidance, interpretation of laws, or any matter that could have legal consequences. Consult a licensed attorney for legal questions.
- Financial, tax, or investment advice. Do not use DialAnytime to make decisions about investments, taxes, retirement planning, insurance, or any financial matter. Consult a licensed financial advisor, accountant, or tax professional.
- Mental health or crisis counseling. DialAnytime is not a substitute for a licensed therapist, counselor, or crisis intervention specialist. If you are in emotional distress, please contact the 988 Suicide and Crisis Lifeline (call or text 988) or a qualified mental health professional.
- Any other advice requiring professional licensure. This includes, but is not limited to, engineering, architecture, real estate, veterinary care, and nutrition counseling.
Any information provided by the AI assistant that touches on these areas is general in nature and should never be treated as a substitute for the guidance of a licensed professional who is aware of your specific situation.
7. Content Ownership and License
For purposes of these Terms:
- "Your Content" means the words you speak, questions you ask, and any other input you provide during calls to DialAnytime.
- "AI Output" means the responses generated by the AI assistant during your calls.
Your Content. You retain ownership of Your Content. By using the service, you grant DialAnytime and its third-party service providers (including our AI and telephony providers) a limited, non-exclusive, worldwide license to process, transmit, and temporarily store Your Content solely for the purpose of delivering the service to you and maintaining the quality and safety of the service.
AI Output. AI Output is generated by third-party artificial intelligence systems and is provided to you for your personal, non-commercial use. You may use AI Output for your own reference and personal purposes. However, AI Output is provided "as is" with no guarantee of accuracy, originality, or fitness for any particular purpose. DialAnytime does not claim ownership of AI Output and makes no representations about whether AI Output may be subject to intellectual property rights of third parties.
Feedback. If you provide us with feedback, suggestions, or ideas about our service (through support requests, surveys, or otherwise), you grant us the right to use that feedback without restriction or compensation to improve our service.
8. Voice Calls and Recordings
Call processing. When you call DialAnytime, your voice is transmitted in real time to our AI provider's systems, where it is converted to text, processed by the AI, and a spoken response is generated and played back to you. This process is essential to delivering the service.
Use restrictions on AI voice output. The AI assistant's voice and responses are generated by third-party AI technology and are subject to the terms and intellectual property rights of those providers. You may record calls for your own personal reference, but you agree that you will not:
- Distribute, broadcast, publish, or publicly share any recording of the AI assistant's voice
- Use the AI assistant's voice output for any commercial purpose, including creating content, products, or services
- Create derivative works based on the AI assistant's voice or responses
- Represent or imply that the AI assistant's responses are those of a human being
- Use recordings to reverse-engineer, replicate, or extract the underlying AI voice or language models
This section does not limit any rights you may have under applicable state or federal law regarding the recording of your own conversations. Violations of the commercial and redistribution restrictions in this section may result in account suspension or termination.
9. Acceptable Use
You agree to use DialAnytime only for lawful purposes and in compliance with these Terms. The following uses are strictly prohibited:
Illegal and Harmful Activity
- Using the service for any illegal purpose or to facilitate illegal activity
- Seeking information intended to harm, injure, or endanger any person
- Using the service in connection with fraud, scams, or deceptive schemes
- Attempting to obtain information related to weapons, explosives, controlled substances, or other dangerous materials
- Using the service to engage in or facilitate harassment, threats, stalking, bullying, or intimidation
- Using the service to generate content that promotes violence, hatred, or discrimination against any individual or group
Abuse of the Service
- Attempting to manipulate, "jailbreak," or circumvent the AI assistant's safety features or content filters
- Deliberately overloading the service or interfering with its operation
- Attempting to reverse-engineer, extract, or replicate the AI models, algorithms, or underlying technology
- Using automated systems, bots, or scripts to interact with the service
- Exploiting errors, bugs, or vulnerabilities in the service rather than reporting them to us
Account and Identity Misuse
- Sharing your account credentials with others or allowing others to use your account
- Creating multiple accounts to circumvent plan limits, suspensions, or bans
- Registering a phone number that does not belong to you or that you are not authorized to use
- Impersonating another person or misrepresenting your identity
Privacy and Rights of Others
- Using the service to collect, aggregate, or compile personal information about other individuals
- Attempting to identify, locate, or profile specific individuals through the AI assistant
- Sharing another person's private or sensitive information during calls
- Infringing on the intellectual property or other rights of any third party
We reserve the right to investigate potential violations and to suspend or permanently terminate accounts that violate these acceptable use provisions, at our sole discretion and without prior notice.
10. Minute Usage and Billing
Important billing term: Please read this section carefully. It explains how call minutes are counted and charged.
Call rounding. Call duration is rounded up to the next whole minute for billing purposes. This means any partial minute is counted as a full minute. For example, a call lasting 2 minutes and 5 seconds is billed as 3 minutes, and a call lasting 30 seconds is billed as 1 minute. Every connected call uses a minimum of 1 minute from your plan balance, regardless of actual duration. This rounding practice is also disclosed on your plan selection page and in your account dashboard.
Dashboard accuracy. Your dashboard displays all call durations and usage statistics in rounded-up minutes to reflect how minutes are actually deducted from your balance. Both the actual call duration and the billed minutes are shown for transparency.
Overage charges. If you use more minutes than your plan includes in a billing cycle, the additional minutes are billed at the per-minute overage rate displayed on your plan. Overage charges appear on your next invoice.
Payment information. You must provide accurate and complete billing information, including a valid payment method. You are responsible for all charges incurred under your account and for any applicable taxes. If your payment method fails, we may suspend your access to the service until payment is received.
Price changes. We may change our subscription prices from time to time. If we increase prices, we will give you at least 30 days' advance notice before the change takes effect on your next renewal date, giving you the opportunity to cancel if you do not agree to the new pricing.
11. Subscriptions and Cancellation
Automatic renewal. Subscriptions renew automatically at the end of each billing cycle. By subscribing, you authorize us to charge your payment method for each renewal period until you cancel.
Free trial. The free trial is a one-time offer for new subscribers. Once you upgrade to a paid plan, the free trial cannot be reactivated, even if you cancel and return later.
Upgrades. Plan upgrades take effect immediately. If you upgrade mid-cycle, the price difference is prorated.
Downgrades. Plan downgrades are scheduled to take effect at the start of your next billing cycle. You keep your current plan's benefits for the remainder of the current period.
Cancellation. You may cancel your subscription at any time through your account dashboard. Cancellation takes effect at the end of your current billing period. You will retain access to the service until that date. No partial refunds are issued for unused time within a billing period.
Refunds. Payments are generally non-refundable, except where required by applicable law. If you believe you are entitled to a refund, please contact support.
12. Email Communications
By creating an account, you agree to receive account-related emails that are necessary to operate the service, including verification codes, login confirmations, payment receipts, subscription confirmations, and renewal notices. These emails are transactional in nature and are required for account functionality.
We do not send marketing, promotional, or advertising emails. We will not share your email address with third parties for their marketing purposes.
13. Termination and Suspension
Termination by you. You may close your account at any time by contacting us through our contact page. If you have an active paid subscription, cancellation of the subscription and account closure are separate actions; please cancel your subscription before closing your account to avoid further charges.
Termination or suspension by us. We reserve the right to suspend or terminate your account, without prior notice, if we reasonably determine that:
- You have violated these Terms, our Privacy Policy, or our acceptable use provisions
- Your use of the service poses a risk of harm to us, our service providers, other users, or any third party
- We are required to do so by law, regulation, or legal process
- Your account has been inactive for more than 12 consecutive months (for free accounts only)
- Continued provision of the service to you is no longer commercially viable
Effect of termination. Upon termination, your right to use the service ceases immediately. We may delete your account data in accordance with our Privacy Policy, except for information we are required or permitted to retain by law.
Appeals. If you believe your account was suspended or terminated in error, you may contact us through our contact page to request a review. We will evaluate your appeal in good faith and respond within a reasonable time.
14. Disclaimer of Warranties
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, KINGMAKER ANALYTICS LLC (DOING BUSINESS AS DIALANYTIME) AND ITS OWNERS, MEMBERS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, AND SERVICE PROVIDERS (COLLECTIVELY, THE "DIALANYTIME PARTIES") DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO:
- WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT
- WARRANTIES THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE
- WARRANTIES THAT AI-GENERATED RESPONSES WILL BE ACCURATE, COMPLETE, RELIABLE, CURRENT, OR FREE OF HARMFUL CONTENT
- WARRANTIES THAT THE SERVICE WILL MEET YOUR REQUIREMENTS OR EXPECTATIONS
YOU ACKNOWLEDGE AND AGREE THAT YOUR USE OF THE SERVICE AND ANY AI-GENERATED RESPONSES IS AT YOUR SOLE RISK. YOU SHOULD NOT RELY ON AI OUTPUT AS A SOLE SOURCE OF TRUTH, FACTUAL INFORMATION, OR AS A SUBSTITUTE FOR PROFESSIONAL ADVICE OF ANY KIND.
Some jurisdictions do not allow the exclusion of certain warranties. In those jurisdictions, the exclusions above apply only to the maximum extent permitted by law.
15. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE DIALANYTIME PARTIES SHALL NOT BE LIABLE FOR ANY:
- INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES
- DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES
- DAMAGES ARISING FROM OR RELATED TO YOUR RELIANCE ON AI-GENERATED RESPONSES
- DAMAGES RESULTING FROM UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR ACCOUNT OR DATA
- DAMAGES ARISING FROM ANY INTERRUPTION, SUSPENSION, OR TERMINATION OF THE SERVICE
THESE LIMITATIONS APPLY EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES AND REGARDLESS OF THE THEORY OF LIABILITY (CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE).
TO THE EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF THE SERVICE SHALL NOT EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT YOU PAID TO DIALANYTIME DURING THE 12 MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100.00).
Some jurisdictions do not allow the limitation or exclusion of liability for certain damages. In those jurisdictions, the limitations above apply only to the maximum extent permitted by law. Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or fraudulent misrepresentation, or any other liability that cannot be excluded by law.
16. Indemnification
To the fullest extent permitted by applicable law, you agree to indemnify and hold harmless the DialAnytime Parties from and against any claims, demands, losses, liabilities, damages, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:
- Your violation of these Terms or any applicable law or regulation
- Your violation of any rights of a third party
- Your use of the service for any purpose prohibited by Section 9 (Acceptable Use)
This indemnification obligation does not apply to claims arising from our own negligence, willful misconduct, or breach of these Terms. If a matter arises for which you owe indemnification, we will notify you promptly and cooperate reasonably in the defense of the claim.
17. Dispute Resolution and Governing Law
Governing law. These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.
Informal resolution first. Before filing any formal legal proceeding, you and DialAnytime agree to first attempt to resolve any dispute informally. You may initiate this process by sending a written description of your dispute to us through our contact page. We will attempt to resolve the dispute within 60 days. If the dispute is not resolved within that period, either party may proceed with formal proceedings.
Binding arbitration. If informal resolution is unsuccessful, you and DialAnytime agree that any dispute arising out of or relating to these Terms or the service shall be resolved through binding individual arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules. Arbitration will take place in the county where you reside (or, at your election, by phone or video conference). The arbitrator's decision will be final and binding, and judgment on the award may be entered in any court of competent jurisdiction.
Arbitration fees. If your claim is for $10,000 or less, DialAnytime will pay all AAA filing and arbitration fees. If your claim is for more than $10,000, the fees will be allocated as provided by the AAA Consumer Arbitration Rules. Regardless of the amount, DialAnytime will not seek attorneys' fees from you in arbitration unless the arbitrator determines that your claim was frivolous.
Small claims court exception. Either party may bring an individual action in small claims court (or the equivalent court in your jurisdiction) instead of arbitration, provided the claim falls within that court's jurisdictional limits.
Class action waiver. To the fullest extent permitted by applicable law, you and DialAnytime agree that any dispute resolution proceedings will be conducted only on an individual basis, and not as a class, consolidated, or representative action. If this waiver is found to be unenforceable with respect to a particular claim, that claim (and only that claim) must be severed from any arbitration proceeding and may be brought in court.
Opt-out right. You may opt out of this arbitration agreement by sending written notice to support@kingmakeranalytics.com within 30 days of first accepting these Terms. Your notice must include your name, email address, phone number, and a clear statement that you wish to opt out of arbitration. If you opt out, disputes will be resolved in the state or federal courts located in Delaware, and you consent to the personal jurisdiction of such courts.
Time limitation. You agree that any claim arising out of or related to these Terms or the service must be filed within two (2) years after the cause of action arose, or it is permanently barred. If applicable law in your jurisdiction requires a longer limitations period that cannot be shortened by contract, that longer period will apply instead.
18. Changes to These Terms
We may update these Terms from time to time to reflect changes in our service, legal requirements, or business practices. When we make changes:
- Material changes (changes that significantly affect your rights or obligations): We will notify you at least 30 days in advance by email to the address associated with your account, and we will update the "Last updated" date at the top of this page.
- Non-material changes (minor clarifications, formatting, or corrections): These will take effect when we post the updated Terms on our website.
Your continued use of the service after the effective date of any changes constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the service and close your account before the changes take effect.
We encourage you to review these Terms periodically. We will maintain previous versions of these Terms available upon request.
19. General Provisions
Entire agreement. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Kingmaker Analytics LLC (operating as DialAnytime) regarding the service and supersede all prior agreements, understandings, and communications, whether written or oral.
Severability. If any provision of these Terms is found by a court of competent jurisdiction to be invalid, illegal, or unenforceable, that provision will be enforced to the maximum extent permissible, and the remaining provisions will remain in full force and effect.
No waiver. Our failure to enforce any right or provision of these Terms at any time does not constitute a waiver of that right or provision. Any waiver must be in writing and signed by DialAnytime to be effective.
Assignment. You may not assign or transfer these Terms or any of your rights or obligations under them without our prior written consent. We may assign these Terms, in whole or in part, to any successor, affiliate, or assignee in connection with a merger, acquisition, reorganization, or sale of assets. If we assign these Terms, we will notify you by email within 30 days of the assignment taking effect, and the assignee will be bound by the same obligations to you under these Terms and our Privacy Policy.
Force majeure. We are not liable for any failure or delay in performing our obligations under these Terms due to events beyond our reasonable control, including natural disasters, power outages, internet or telecommunications failures, government actions, pandemics, or other force majeure events.
Headings. The section headings in these Terms are for convenience only and have no legal effect.
Survival. Sections that by their nature should survive termination of these Terms will survive, including but not limited to: Content Ownership, Disclaimer of Warranties, Limitation of Liability, Indemnification, Dispute Resolution, and General Provisions.
